Terms of Service
memoirkin is not a medical service. It does not provide medical advice, diagnosis, or treatment recommendations. It is a personal organization tool that helps you keep track of your own health information. Nothing in memoirkin should be used to make medical decisions. 1. What memoirkin is
memoirkin is a personal health record organizer. It gives you — the patient or caregiver — a place to collect, organize, and understand your health history in plain language. It is not a clinical system, not an electronic health record, and not a patient portal. It does not replace your relationship with your healthcare providers or with any health system's tools.
memoirkin is provided by Aaron Whipkey, sole founder, operating as memoirkin ("we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of memoirkin, including the website at memoirkin.com, the application at app.memoirkin.com, and any related services (collectively, the "Service").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Who can use memoirkin
You must be at least 18 years old to create an account. If you are creating a profile for a child or another person in your care, you represent that you are authorized to do so — as a parent, legal guardian, or authorized caregiver — and that you take responsibility for how the Service is used on that person's behalf.
memoirkin is intended for personal, non-commercial use. You may not use the Service on behalf of a healthcare organization, employer, insurer, or any third party without our written consent.
3. Your account
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized access.
We may suspend or terminate accounts that violate these Terms, misuse the Service, or engage in activity that could harm other users or the Service itself.
4. Connecting your health records
memoirkin may allow you to connect to your electronic health records through your healthcare provider's patient portal using a standard called SMART on FHIR. When you choose to connect:
- You initiate the connection — we only pull data you explicitly authorize.
- You can disconnect at any time, which stops future data pulls. Previously retrieved data remains in your memoirkin account until you delete it.
- The accuracy of data retrieved from your health records depends on your healthcare provider's systems. memoirkin does not modify, correct, or interpret that data clinically.
- Connecting your health records is optional. memoirkin also works with information you enter yourself.
5. Not medical advice — important
memoirkin is a documentation and organization tool. It is not a licensed medical service, and nothing it produces — including AI-generated summaries, symptom documentation, or anything else — constitutes medical advice, diagnosis, or a treatment plan.
The AI features in memoirkin are designed solely to help you organize and document information you provide. They are constrained to documentation only and are explicitly prohibited from diagnosing conditions, recommending treatments, or advising you on clinical decisions. Any output from memoirkin should be reviewed with a qualified healthcare provider before you act on it.
Self-reported information in memoirkin is not a substitute for a clinical record. It has not been reviewed or verified by a clinician.
6. Your information
You own the health information you store in memoirkin. We do not sell your personal or health information. We use it only to provide and improve the Service as described in our Privacy Policy.
You are responsible for the accuracy of information you enter. Do not enter information that belongs to someone else without appropriate authorization.
You may request a copy of your data or ask us to delete your account and associated information at any time by contacting [email protected]. We will respond within 30 days.
7. Security
We take reasonable technical and organizational measures to protect your information, including encryption in transit and at rest, network isolation, and least-privilege access controls. No system is perfectly secure. In the event of a breach affecting your information, we will notify you and the appropriate regulators as required by applicable law.
8. Limitation of liability
The Service is provided "as is" and "as available." We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any information in the Service.
To the fullest extent permitted by law, memoirkin and its founder shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service, including but not limited to reliance on any health information retrieved, organized, or summarized by the Service.
memoirkin is not a licensed healthcare provider. Use of the Service does not create a provider-patient relationship of any kind.
9. Changes to these Terms
We may update these Terms from time to time. When we do, we'll update the date at the top of this page and, for material changes, notify you by email or in-app notice. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
10. Governing law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Larimer County, Colorado.
